Judgment
Sabina, J.—Petitioners have filed this petition u/s 438 of the Code of Criminal Procedure (for short ''Code of Criminal Procedure'') for grant of anticipatory bail in FIR No. 45 dated 8.6.2010 under Sections 406/498-A of Indian Penal Code (in short ''IPC'') registered at Police Station PAU Ludhiana District Ludhiana.
At the time of issuance of notice of motion, the following order was passed by this Court on 05.8.2010:
Learned Counsel for the Petitioners has submitted that the complainant after marriage with Milkha Singh, left for England. The complainant came to India and lodged the FIR and has thereafter, again left for England and is presently residing in England. The Petitioners have been falsely involved in this case due to their relationship with Milkha Singh.
Notice of motion for 16.8.2010.
In the meantime, in the event of arrest, the Petitioners be admitted to interim bail subject to the satisfaction of the Arresting Officer. They shall abide by the provisions of Section 438(2) of the Code of Criminal Procedure.
List along with CRM-M No. 21314 of 2010.
Learned State Counsel, on instructions from ASI Paramjit Singh, has submitted that the Petitioners have joined the investigation but the gold articles are yet to be recovered.
Learned Counsel for the complainant has also opposed the petition.
However, keeping in view the fact the complainant had left for England alongwith her husband after marriage, it would be just and expedient to confirm the interim bail granted by this Court as the Petitioners have joined the investigation.
Accordingly, without expressing any opinion on the merits of the case, the interim bail granted by this Court on 05.8.2010 is made absolute.
Petition stands disposed of accordingly.
