The instant writ application has been preferred by the petitioners for a direction upon the respondent-authorities to initiate the process of appointment of the petitioners pursuant to the advertisement published in newspaper Hindustan (Dhanbad) dated 07.09.2009 being Advertisement No. 01 of 2009 as the petitioners have duly appeared in the interview exam and also qualified the Cycle test conducted by the respondents.

Learned counsel for the respondent-State referring to paragraph no. 9 of the counter affidavit submits that it has been specifically stated in the said paragraph that in course of the process of appointment proceeding vide Finance Department Jharkhand, Ranchi’s Sankalp Memo No. 1859 dated 02.09.2011 it was decided that for appointment of the candidates in Fourth Grade the minimum qualification shall be 10th pass and for this reason process of Advertisement No. 01 of 2009 dated 07.09.2009 was stopped immediately vide Resolution dated 29.04.2017.

Having regard to the aforesaid statement made in paragraph no. 9 of the counter affidavit and also after perusing the said Annexure it appears that in course of the process of appointment proceeding vide Finance Department Jharkhand, Ranchi’s Sankalp Memo No. 1859 dated 02.09.2011 it was decided that for appointment of candidates in Fourth Grade the minimum qualification shall be 10th pass and for this reason process of Advertisement no. 01 of 2009 dated 07.09.2009 was stopped immediately vide Resolution dated 29.04.2017. It also appears that the said letter is of May 2017 and the instant writ application was filed in December 2022 and no reason has been assigned in the writ application for such a huge delay. Moreover, the said letter which is annexed as Annexure-A (page 9 of the counter affidavit) has not been assailed in the instant writ application. Accordingly, no relief can be granted to these petitioners.
