Judgment
The counsel for the applicant / MCD has placed before us a photograph of the proposed site where the 18 families of the Gadia Lohar community are to be relocated temporarily. At present they are residing in a small triangular piece of land in the centre of the road on the roundabout near Tyagaraj Stadium.
Along with the aforesaid photograph, a map has also been placed before us, which indicates the existing location of the said 18 families and the area has been marked in Green. The map also shows the proposed location which is marked in Orange. The proposed location has a length of 90 metres approximately.
Going by the standard that each jhuggi would be occupying an area of 3 x 3 metres, the entire group of 18 jhuggis can easily be accommodated along the length of the proposed location adjacent to the wall on the side of the Road Under Bridge (RUB) at Prem Nagar.
The learned Counsel appearing for the said families of Gadia Lohar assures this Court that the 18 families would voluntarily move from the present location to the proposed location over the weekend, that is, on 28th and 29th of August, 2010. The shifting would be completed on 29th August, 2010. She submitted that in the process of moving, the tarpaulin covers of the jhuggis may get damaged. The learned Counsel for the MCD has, upon instructions, stated that tarpaulin covers would be provided for each of the 18 dwelling units which are to be set up at the proposed location. Apart from this, the MCD shall also make arrangements for temporary toilets at the proposed location. The same would be arranged on 28th and 29th August, 2010 itself.
It is well understood by all the parties that this relocation is only a temporary measure and the actual relocation would be in terms of the judgment dated 11.02.2010. It is also clearly understood that the MCD shall conduct a survey of the Gadia Lohar community residing at the aforesaid location in a manner that each person residing there is documented. Photographs of each of the persons would be taken and the names of the head of the family as also the members of the family along with their ages would be recorded. This survey will be conducted on 27.08.2010 between 4 pm and 7 pm at the site.
This application stands disposed of.
