The petitioner has filed the present petition under Section-482 of the Criminal Procedure Code, 1973 (Cr.P.C.) with the prayer that the

proceedings of Khliehriat P.S. Case No. 108 (5)/2014 pending before the Additional District Magistrate, East Jaintia Hills District, Khliehriat be

transferred to any other District and Sessions Courts.

The case of the petitioner is that the petitioner lodged a complaint before the Officer-in-Charge, Khliehriat Police Station, East Jaintia Hills

District, Meghalaya against the accused persons and on the basis of which FIR No. 108 (5) 14 U/s 364 (A) IPC was registered on 29th May

2014.

Learned counsel appearing on behalf of petitioner submits that accused persons were admitted interim bail vide order dated 17th March, 2015.

Later on vide order dated 2nd April, 2015 application for bail was rejected and interim bail granted vide order dated 17th March, 2015 was

cancelled.

Learned counsel for petitioner further submits that the respondents No. 5 to 11 herein (accused persons) moved an application under Section-

437 Cr.P.C. and bail was granted by Additional District Magistrate, East Jaintia Hills District, Khliehriat vide order dated 17th September, 2015.

After some hearing, Mr. S.M. Suna, learned counsel appearing on behalf of petitioner seeks permission to withdraw the present petition with

liberty to avail appropriate legal remedy.

Ms. N.G. Shylla, learned counsel appearing on behalf of respondents No. 1 to 4 has no objection to the same.

In view of the facts and circumstances of the case and submission made by learned counsel for petitioner, the present petition is dismissed as

withdrawn. However, the petitioner is at liberty to avail appropriate legal remedy.
