Judgment

This is the first application filed under section 483 of BNSS, 2023 for grant of regular bail on behalf of applicant Muinuddin Ahmed S/o Mohd. Shfiq Ansari in connection with Crime No.508/2025, registered at Police Station Hanumantal, District Jabalpur under sections 296,118(1), 351(3) and 118(2) of BNS, 2023.
2 . The present applicant is in custody since 26.08.2025. After investigation, chargesheet has been filed. The allegation against the present applicant is that victim Mohd. Ayan Khan came to the hotel of the present applicant named Sultan Hotel, which is situated in the area of Hanumantal, where the brother of victim was sitting. He asked for Rajshree Pouch from the present applicant, who was making tea and thereafter some altercation took place between both of them and the present applicant poured the hot water upon the victim. Resultantly, the victim sustained burn injuries over the right shoulder and chest. He was immediately taken to Victoria Hospital and from Victoria Hospital he was referred to Medical College Hospital, Jabapur where he remained admitted from 13.07.2025 to 21.07.2025 and as per the discharge summary, 10-15% superficial to deep scald burn was investigated and thereafter the treatment was given to the victim with an advise for Plastic Surgery.
Counsel for the applicant submits that the incident took place all of sudden and there was no occasion for the present applicant to pour the hot water on the victim. He further submits that it was only an accident and the present applicant has been falsely implicated in the case as the incident took place in his hotel. He further submits that the applicant is in custody since 26.08.2025. Investigation is over and chargesheet has been filed. Trial will take considerable time in coming to a conclusion. He prays for enlarging the applicant on bail.
Counsel for the State opposed the bail application on the ground that only on asking for Rajshree Pouch, the applicant poured hot water on the victim. Resultantly the victim sustained 10-15% burn injuries, which are grievous in nature. Sufficient evidence is available against the present applicant in the chargesheet. He prays for dismissal of the application.

Considering the facts that incident took place due to some altercation between the applicant and victim, the victim has already been discharged from the hospital, investigation is over and chargesheet has been filed, without commenting on the merits of the case, I deem it proper to allow this application.
Accordingly, the application is allowed. The applicant is directed to be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount amount to the satisfaction of trial Court for his regular appearance before the trial Court during trial with a condition that he shall remain present before the concerned Court on all the dates fixed by it during trial. It is directed that the applicant shall abide by the conditions as enumerated under section 480(3) of BNSS.
