Antony Dominic, J.—The prayer sought in this writ petition is to direct the 1st Respondent to prevent the flood light football match being conducted at Kadathamanna in Malappuram District in violation of the stop memo issued by the Sub Inspector of Police, Mangada Police Station. According to the Petitioner, under the convener ship of the 2nd Respondent, a foot ball committee has been constituted and that the committee is now conducting a football match.

It is stated that in connection with the football match, various untoward incidents have happened resulting in the registration of Crime No. 192/2011. It is stated that on account of these incidents, a stop memo was issued by the Sub Inspector of Police and that ignoring the stop memo, football match is being conducted. It is also the case of the Petitioner that on account of the football match, that is conducted during the time when the Higher Secondary Examinations are scheduled, serious inconvenience is caused to the students who are residing in the neighbourhood. It is with these allegations, the writ petition has been filed.

As far as the inconvenience pointed out by the Petitioner is concerned, the learned Government Pleader submits that football match is only up to 10th March, 2011. As far as the allegation of the Petitioner that the match is being conducted ignoring the stop memo issued by the Sub Inspector of Police is concerned, the learned Government Pleader has made available to me a copy of the instructions which he obtained from the 1st Respondent. It shows that subsequent to the issuance of the stop memo, the Sub Inspector of Police convened a meeting of all concerned and on a specific undertaking by all sides that no untoward incident will be repeated, the Sub Inspector himself has permitted the football match to continue till 10.3.2011. Therefore, it is obvious that based on the consensus from among the parties, the stop memo was lifted.

If that be the case, the allegation of the Petitioner that ignoring the stop memo the football match is being conducted, it cannot be factually correct. In such circumstances, this Court will not be justified in interfering with the ongoing football match.

The writ petition fails and it is accordingly dismissed.
