The petitioner claims to be in possession and enjoyment of 3.6 acres of land in Re-Sy. No.112/2 of Malappattam village of Taliparamba Taluk. According to the petitioner, the petitioner had paid tax on the said property till 10-01-1983 and thereafter the tax is not being accepted in respect of the said property and the said property is recorded in the village books and revenue records as Government property. According to the petitioner, the petitioner is a cultivating tenant under the 'Karakkatidam vaka tharavadu'. The petitioner has filed Ext.P4 representation before the Village officer.

The learned counsel for the petitioner would submit that the petitioner will be satisfied if a direction is issued to the 1st respondent to consider the application in accordance with law.

The learned Senior Government Pleader submits that there is no objection in such a direction being issued.

Accordingly, this writ petition will stand disposed of directing the 1st respondent to consider and pass orders on Ext.P4 application filed by the petitioner in accordance with the law within a period of 3 months from the date of receipt of a certified copy of this judgment. The petitioner shall produce a copy of the writ petition along with a copy of the judgment before the Village Officer for compliance.

I make it clear that I have not expressed any opinion on the merits of the petitioner's claim. It is open to the 1st respondent to consider the matter in accordance with the law.
