The petitioner is the sole accused in Crime No.311/2011 of Pulikeezhu Police Station, Pathanamthitta alleging the commission of offences under Sections 403, 406 and 420 of the Indian Penal Code.
The case is now pending in the long pending Register as L.P.No.29/2022 on the file of the Judicial First Class Magistrate Court, Thiruvalla. The learned counsel for the petitioner submits that the petitioner never received any summons from the court below. He prays that a direction may be issued to the Judicial First Class Magistrate Court, Thiruvalla to consider any bail application that may be filed by the petitioner on the date of surrender.
Heard the learned Public Prosecutor also.
Having regard to the facts and circumstances of the case, this Crl.M.C. will stand disposed of directing the Judicial First Class Magistrate Court, Thiruvalla to consider any bail application that may be filed by the petitioner in L.P.No.29/2022 on the file of Judicial First Class Magistrate Court, Thiruvalla on the date of surrender provided, the petitioner surrenders before the court within a period of two weeks from today. Till the orders are passed in the bail application be filed by the petitioner, any warrant issued against the petitioner shall remain suspended, and shall not be executed.
This Crl.M.C. is disposed of accordingly.
