This Bail Application is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023.
The petitioner is the 5th accused in Crime No.153/2024 of Kadinamkulam Police Station, Thiruvananthapuram. The above case is registered against petitioner and other accused for the offences punishable under Sections 363, 294(b), 323, 324 and 395 of the Indian Penal Code (IPC), 1860.
The prosecution case is that, on 17.02.2024, at about 06:00 a.m., the petitioner, who is the 5th accused, along with other accused with an intention to commit dacoity, abducted the defacto complainant and took him to a vacant house and thereafter manhandled him and caused injuries and also damaged the mobile phone of the defacto complainant worth Rs.15,000/-. Accused thereby committed the aforementioned offences.
Heard the counsel for the petitioner and the learned Public Prosecutor.
Accused is in judicial custody from 21.11.2024. Prima facie there are materials reveling the involvement of the petitioner in the crime alleged. Regard being had period of detention undergone and the progress made in the investigation, this Court is of the view that, grant of bail will not cause any impediment in the process of investigation and a fair and full probe can be well ensured by granting bail to the petitioner by imposing necessary conditions. Accordingly, Bail is granted to the petitioner on the following conditions:-
The applicant shall execute a bond for Rs.50,000/- (Rupees Fifty Thousand only) with two solvent sureties each for the like-sum to the satisfaction of this Court.
The petitioner shall appear before the Investigating Officer on every Saturday in between 10 a.m and 12 noon for a period of three months or till final report is filed whichever is earlier.
Accused shall not influence or intimidate the prosecution witnesses.
He shall not involve in any offence of similar nature while on bail.
It is made clear that violation of any of the condition stipulated above will result in the cancellation of bail.
