Judgment
This writ petition has been filed by the petitioner seeking a direction to the respondents to process the application of the petitioner for granting recognition / permission to run B.A.B.Ed./B.Sc.B.Ed. (4 years integrated course) and thereafter issue a formal letter of recognition in favour of petitioner Institution as per Regulations, 2014.
The petitioner was issued a show-cause notice dated 26.8.2016 in relation to the prayer made in the present writ petition pointing out the decision taken by the Northern Regional Committee of the NCTE, however, the petitioner did not respond to the said notice.
Learned counsel for the petitioner submits that in a similar nature writ petition being Choudhary P.R. Teacher Traning College v. NCTE & Anr.: S.B. Civil Writ Petition No.17286/2018, decided on 27.5.2019, a Coordinate Bench of this Court had permitted filing of the response on payment of cost of Rs.11,000/- and, therefore, similar order be passed.
Learned counsel for the respondents does not dispute the fact that the issue raised in the present writ petition is similar to that in the case of Choudhary P.R. Teacher Traning College (supra).
In the case of Choudhary P.R. Teacher Traning College (supra), a Coordinate Bench of this Court ordered as under:-
"6. After hearing learned counsel for the parties as well as perusing the record of the case, this Court finds that the petitioner's prayer to respond to the aforesaid notice, in the interest of justice, has to be allowed and hence, the same is allowed. The petitioner shall respond within a period of 30 days from today and thereafter, his application for recognition shall be considered, strictly in accordance with law. The NCTE shall consider the response, which is to be filed within a period of 30 days only on deposition of a cost of Rs.11,000/- alongwith the reply.
With the aforesaid observations and directions, the present petition is disposed of. Stay petition also stands disposed of accordingly."
In view of the submissions made, the petition filed by the petitioner is disposed of with similar directions as given by the case of Choudhary P.R. Teacher Traning College (supra)
