This Writ Petition is filed challenging the impugned order dated 27.11.2025 passed by the 2nd Respondent, wherein the third respondent was appointed as Fit person.
The learned counsel appearing for the 4th respondent would submit that that the 4th respondent has filed a Writ Petition before the Division Bench of this Court in W.P.(MD)No.30305 of 2025 and the same is pending. Therefore, the preset Writ Petition may be clubbed along with that Writ Petition.
Considering the said submission, this Court directs the Registry to post this matter along with W.P.(MD)No.35329 of 2025, which is pending before the Division Bench, after getting appropriate orders from the Hon'ble Administrative Committee.
The learned counsel appearing for the petitioners seek interim order citing the reason that the fit person is going to take charge tomorrow and if the fit person is take over the charge, then the Writ Petition would be infructuous. This Court is of the view that ultimately, this Court set aside the impugned order, the petitioner may take over the charge. Therefore, there is no requirement of granting interim stay.
