Heard Mr. D.K. Mohanty, learned counsel for the Appellant and Mr. B.S. Tripathy, learned counsel for the Respondent.

One interim application is filed in court today by the Appellant praying for modification of order dated 13th December, 2021 in respect of depositing the arrear rent amount.

It is fairly admitted by the learned counsel for the Appellant that fixed deposit of only 11 lakh has been made in terms of order dated 13th December, 2021 of this Court instead of the entire arrear rent amount. Mr. Tripathy, learned counsel for Respondent raised his objection that the entire arrear rent amount would come around 60 lakhs.

The interim order dated 13th December, 2021 is extended till 26th April, 2022 subject to deposit of the total amount as per order dated 13th December, 2021 within a period of two weeks from today.

It is made clear that failing to make deposit and filing of a receipt thereof before the Trial Court on or before 11th April, 2022 shall entail vacation of interim order dated 13th December, 2022 and the trial court is at liberty to proceed with the execution case thereafter.

List the matter on 26th April, 2022. In the meantime copy of the LCR in C.S. No.1058 of 2010 of the Court of Senior Civil Judge, Bhubaneswar be obtained.

An urgent certified copy of this order be issued as per rules.
