Judgment

The subject matter of this Writ Petition is substantially similar to the one in W.P.No.19849/2021 (GM-POLIC) between M/S. TUMAKURU GRAIN MERCHANTS vs THE CIRCLE INSPECTOR OF POLICE & OTHERS, disposed off by this Court on 09.12.2021, wherein operative portion of the said judgment reads as under:
“In the above circumstances, this writ petition is disposed off directing the first respondent to assist the Shirastedar of the Court below in taking possession of the subject property immediately after petitioner makes the written request in that regard.
Non-compliance of this direction may result into multiple adverse entries being made in the Service Register of the police officials concerned.”
The Division Bench of this Court in W.A.Nos. 932-933/1974 between A.V.VINODA & ANOTHER Vs.STATE OF KARNATAKA BY ITS COMMISSIONER & SECRETARY disposed of on 11.12.1974, has held that the Court should treat the like-cases alike and if relief is granted to a litigant it has to be extended to a similarly circumstanced litigants as well, there being no derogatory circumstances.
In view of the above, this Writ Petition is also disposed off with the same direction as has been granted in the cognate writ petition to the petitioner herein as well.
All contentions are kept open.
No costs.
