Learned Additional Government Advocate accepts notice for the respondent-State.
Heard the learned counsel appearing for the parties.
In this writ petition, the petitioner has challenged the impugned show cause notice dated 19.10.2022 (Annexure-C) issued by the 2nd respondent.
Learned Additional Government Advocate has placed reliance on the judgment of the Hon’ble Apex Court in the case of State of Punjab Vs. M/s. Shiv Enterprises and Others, decided on 16.01.2023 in Civil Appeal No.359 of 2023 and submitted that the petitioner be directed to file reply to the said show cause notice.
Having taken note of the submission made by the learned counsel appearing for the parties and the law declared by the Hon’ble Apex Court in the aforementioned matter, I am of the view that, liberty is reserved to the petitioner to file reply to the impugned show cause notice within a period of four weeks from today and thereafter, the authority shall pass appropriate order in accordance with law.
Reserving liberty as stated above, writ petition is disposed of.
