This writ petition is filed challenging Exts.P7 and P8 orders passed requiring the petitioner to stop operation of the quarrying in Ayyampuzha village of Aluva Taluk until a certificate is obtained from the revenue department to prove that quarrying permits/lease is not granted in land assigned for agricultural purposes. It is submitted that several quarries were issued with such stop memos, which were challenged before this Court in a batch of writ petitions. By judgment dated 06.11.2014, the writ petitions were disposed of quashing the impugned orders, but making it clear that the geologist is free to take action against the petitioners for cancellation of the quarrying permits based on any decision taken by the competent authority under the Land Assignment Rules. The petitioners were also entitled for renewal of quarrying lease, subject to initiation of proceedings under the Land Assignment Act and Rules.
The learned counsel for the petitioner submits that the writ petition is identical to the writ petitions which were disposed of by this Court by the common judgment referred above. The impugned orders had been stayed by this Court by its interim order dated 22.04.2014 and the respondents were also directed to consider the application of the petitioner for transit passes.
In the above view of the the matter, this writ petition is disposed of in terms of the common judgment dated 06-11-2014. However, this is will not stand in the way of any proceedings already initiated or proposed to be initiated under the provisions of the Land Assignment Act and Rules and consequent action, if any, by the geologist.
The writ petition is ordered accordingly.
