Mr. Nanda, learned senior advocate appears on behalf of petitioner and submits, impugned is revocation of consent letter dated 25th April, 2022 issued by State Pollution Control Board (Board). He submits, closure of his client’s unit will have severe consequences on the employees as well as fulfillment of tender obligations of supply to the Government. He points out from inspection report of inspection made on 31st March 2022 that, inter alia, discrepancy in capacity of effluent treatment plant and discharge was 13 KLD. He relies on judgment of the Supreme Court in Sterlite Industries (India) Ltd. v. Union of India (UOI), reported in (2013) 4 SCC 575, paragraph 36 (Manupatra print) to submit, closure is not the answer to address the issue of environment pollution versus the need for having industry.

On direction for notice Mr. Nanda submits, his client be given liberty to personally serve and file affidavit of service.

Petitioner will serve copy of the petition and this order on opposite party nos.2 and 3 and also deliver the same to office of learned Advocate General (regarding service on opposite party no.1).
