Judgment
We have heard Mr. V. Sudhakar, learned counsel appearing for the applicant as well as Mrs. Rita Chandrasekar, learned counsel appearing for the State Pollution Control Board (Board). We direct the Miscellaneous Application to be numbered by the Registry.
The Miscellaneous Application is for modifying our order dated 08.11.2016 passed in Appeal No.34 of 2016. In the said order which relates to retransporting of imported paper waste, on a representation made that M/s. India Cements Ltd. is the authorized agent for the purpose of disposal of the said waste we have passed the order by disposing the appeal with a direction to the Tamil Nadu Pollution Control Board to pass appropriate orders within two weeks so as to enable M/s.India Cements Ltd., the authorised authority, to dispose the waste.
In the present application, the appellant in the appeal, has stated that it was after the order passed by this Tribunal, M/s.India Cements Ltd. is no more authority for the purpose of disposal of waste but it is the Ramky Energy and Environment Ltd. which is the authority. It appears that M/s.Ramky Energy and Environment Ltd. has approached the Board for granting necessary approval. The learned counsel appearing for the Board would submit that on the basis of Ramky's request approval will be granted at an early point of time and thereafter Ramky will undertake the activity of safe disposal of the waste as stated in the original order in the appeal. Ramky's application shall be considered by the Board and necessary orders shall be passed expeditiously.
In view of the same, the order in the Appeal No.34 of 2016 dated 08.11.2016 stands modified to the effect that it is M/s.Ramky Energy and Environment Ltd. which has to undertake safe disposal of waste after obtaining necessary permission from the Board and the waste is to be transported from Tuticorin Port to authorised common Bio-medical waste disposal facility at Virudhunagar for the said safe disposal. With the above modification, the appeal stands disposed of. The other directions given in the order dated 08.11.2016 which include the monitoring of the transportation and filing report before the Tribunal after the entire activity is completed shall stand as it is.
