The petitioner herein initially came up for police protection to carry on the process of manufacturing of refining waste oil. During the course of proceedings, it was made clear that a stop memo was issued so far as the processing of refining waste oil and the same is subject matter of challenge in W.P(C) No. 338 of 2012.
However, after noticing the precarious situation in which the petitioner company was placed, because of the stop memo, as the goods supplied by various suppliers were waiting to reach the premises in question and also having regard to the apprehension of the party respondents that under the guise of bringing in goods, which already arrived at the premises, the petitioner may continue the process of refining oil, we appointed an Advocate Commissioner to monitor and supervise the storing of the raw material lying in the premises of J.M.V. Petroleum Bunk and also to monitor the finished products lying in the factory godown to be removed from the premises. While reporting back the details of the above said monitoring and supervision, the learned Advocate Commissioner appointed by this Court has made several remarks, including complaints of the local residents, who said to have appeared before him pouring out their grievances.
The apprehension of the petitioner is, if this report of the Advocate Commissioner is placed before the learned Single Judge, who is considering the challenge against the stop memo, it may have some impact on the merits of the case, therefore, the petitioner seeks proper direction in this regard.
The very purpose of appointment of the Advocate Commissioner is to monitor and supervise bringing of raw materials and move out finished products in question, we do not find any reason to keep the writ petition pending, as there is no occasion, which demands such protection at the minute. However, we make it clear that none of the observations of the Advocate Commissioner in his report can be relied upon by the party respondents before the learned Single Judge.
The Writ Petition is disposed of.
