The present petition is filed under Article 226 of the Constitution of India by the borrower being aggrieved by the notice issued by the secured creditor under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter to be referred to as the Act, 2002).

Counsel for the petitioner submits that the petitioner has already challenged the said notice by filing an application under Section 17 of the Act, 2002 as SA No.1191/2025 but because the presiding officer in DRT, Jabalpur is not available, the hearing could not take place. She further submits that the matters are being heard by DRT, Lucknow. The tentative date which is has been fixed online is 29/1/2026.

Considering the aforesaid submission, without entertaining the petition, we dispose of the matter by directing the Registrar of DRT, Jabalpur to place the pending case of the petitioner before the Presiding Officer who is hearing the matters of DRT, Jabalpur on 29/1/2026.

With the aforesaid, present petition is disposed of.
