Judgment
Heard the learned counsel on recall application. A recall application has been filed by the appellant for recalling the order dated 21.07.2026 by which the appeal was treated to have been dismissed in view of the order dated 13.05.2026 passed by the Hon’ble Chairperson of this Appellate Tribunal. The said order was passed as per office report dated 21.07.2026, by which it was reported that the deficit court fee of Rs. 29,750/- was not deposited by the appellant as directed by the Hon’ble Tribunal vide order dated 13.05.2026 but the fact that the said deficit court fee was already deposited by the appellant on 02.04.2026 as reported by the registry vide report dated 02.09.2026. Thus the order dated 21.07.2026 passed by the undersigned is contrary to the fact on record. Hence the said order is hereby recalled and the present appeal is being listed on 18.09.2026 before Hon’ble Chairperson for further orders.
The recall application is accordingly disposed off.
