This appeal has been filed under Section 19 of The Consumer Protection Act, 1986 in challenge to the Order dated 20.05.2019 of the State Commission in complaint no. 109 of 2017.
Repeatedly called out, intermittently.
No one appears on behalf of the appellant. On the previous date i.e. on 26.05.2022 also no one had appeared on behalf of the appellant.
Mr. Chaitanya Mahajan, learned counsel appears for the respondent. He had also appeared on the earlier date i.e. 26.05.2022.
The learned counsel submits on instructions that the matter has been settled between the appellant and the respondent. Submission is that the dispute no longer survives.
No comments of this Commission on the contents and ingredients of the settlement said to have been arrived at.
Be that as it may, in the absence of the appellant yet again the appeal is dismissed in default for lack of prosecution.
However, in the interest of justice, liberty is granted to the appellant to revive its appeal if it so wishes within 30 days from today by filing appropriate application.
The Registry is requested to send a copy each of this Order to the parties and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
