Judgment
The present writ petition is being entertained only because the Second Appellate Tribunal has not yet been constituted.
Issue Notice. Since Mr. P.K. Parhi, learned Deputy Solicitor General of India accepts notice for Union of India, Mr. Sunil Mishra, learned Additional Standing Counsel accepts notice for Opposite Party Nos.2, 4, 5 & 6 and Mr. A. Kedia, learned Junior Standing Counsel accepts notice for Opposite Party No.3, let required number of copies of the writ petition be served on them within three working days. Reply be filed within eight weeks and rejoinder thereto, if any, be filed before the next date.

Learned counsel for the Petitioner states that at the stage of first appeal, 10% of the tax demanded has already been paid. Subject to the Petitioner paying 20% of the remaining tax within four weeks hence, no coercive steps shall be taken against the Petitioner during pendency of the writ petition.
The application is accordingly disposed of. Issue urgent certified copy of this order as per Rules.
