Judgment
Sudhanshu Dhulia, J
The petitioner before this Court was one of the auction bidders pursuant to a notice dated 25.06.2017 issued by the respondent for the work of
catering for the year 2017-18, 2018-19 and 2019-20. According to the petitioner, he was the only person who was technically qualified and therefore
the contract was liable to be executed in his favour. But, this the respondent has not done and instead it is going for a fresh tender process. Aggrieved,
the petitioner has filed the present writ petition.
As far as the claim of the petitioner that since he was the only person who qualified the technical bid and therefore is liable to be given the contract,
this contention is without any basis inasmuch as no rights have accrued in favour of the petitioner as yet. What the petitioner has done by making the
bid was only makes an offer which was not accepted and this has not resulted in any contract, which may give any right to the petitioner. The
Government is always free to reject the offer and to go for a fresh process.
Consequently, the prayer as sought by the petitioner cannot be granted in a writ petition. Writ petition therefore fails and is hereby dismissed.Â
