Judgment
N.A. Britto, J.—Heard Shri Furtado, the Learned Counsel on behalf of the Applicants and Ms. L. Dharwadkar, the learned Addl. Govt. Advocate on behalf of the Respondent. 3/07/2000 at Panaji and whose marriage is registered under no. 493 of 2000 in the Civil Registration Office, Ilhas Panaji, and, whose marriage has now been dissolved by judgment dated 20/05/2005 of the Judicial Officer of the Superior Court of California, County of Los Angeles, U.S.A
Both the Applicants have prayed for confirmation of the said judgment dated 20/05/2005 passed in case no. BD 418272 by the said Judicial Officer of the Superior Court of California, U.S.A. They have also prayed that the Civil Registrar, Ilhas at Panaji be directed to cancel the registration of the marriage of the Applicants under registration no. 493 of 2000.
In support of the Application, Shri Furtado has placed reliance on the judgment of this Court dated 24/02/1995 in M.C.A. No. 133 of 1994 and also on the Division Bench judgment of this Court dated 21/07/2000 in L.P.A. No. 19 or 1998 in the case of Saturnino Epifanio Ralph Barros @ Ralph Barros V/s. Tina Noronha e Barros & Anr. Reliance also is placed on another judgment of the learned Civil Judge of this Court dated 15/09/2006 in M.C.A. No. 317 of 2006.
In the light of the said judgment of the learned Division Bench of this Court and followed in M.C.A. No. 317 of 2006 and as there is no challenge to the application, the application deserves to succeed. Hence, the same is granted in terms of prayer clause (a) and (b) of the application. The divorce granted by judgment dated 20/05/2005 by the Judicial Officer of the Superior Court of California, U.S.A. is hereby confirmed and the Civil Registrar, Ilhas, Panaji is hereby directed to cancel the registration of their marriage registered under no. 493 of 2000. Application disposed of on the above terms.
