It is further submitted by the learned counsel for the appellants that all 66 vehicles are being used by the company and its sister concern for their,,,,,
business purposes. If the possession of the vehicles are taken it would affect the operation of the business. The impugned order is of 2018 and the,,,,,
present notice for physical possession has been issued after two years. The learned counsel also challenged the notice on the ground that it is not in,,,,,
accordance with relevant provisions under PMLA hence the same is illegal. In the stay application the appellant has pleaded that this Tribunal vide,,,,,
order dated 17.10.2018 had given liberty to the learned counsel for the appellant to press for an interim order in case any notice is issued.,,,,,
It is also submitted by the learned counsel for the appellant that the Respondent has already withdrawn the aforesaid amount from the said account,,,,,
which is more than the amount confirmed by the Adjudicating Authority. The said amount may be restored back to the said account.,,,,,
On the aforesaid grounds, the learned counsel for the appellants prayed for stay of the operation of the impugned notice and sought direction for return",,,,,
of the aforesaid amount.,,,,,
On the other hand the learned counsel for the Respondent raised objections and sought two weeks time to file reply to the stay application, which is",,,,,
not objected.,,,,,
Heard both sides. In the present case there is involvement of 66 vehicles which are stated of being used by the company and its sister concern for,,,,,
their business purposes and that the possession notice has been issued after more than two years.,,,,,
Considered the submission of both the parties and perused the material available on record. I am satisfied that the appellant has shown a prima facie,,,,,
case for grant of an ad-interim order of ‘status quo’, with respect to the aforesaid vehicles, till the next date of hearing. Both the parties are",,,,,
directed to maintain ‘status quo’ with respect to the aforesaid vehicles. The other prayer of the learned counsel for the appellant regarding the,,,,,
transfer of amount would be taken up at the time of hearing.,,,,,
The aforesaid order of ad-interim order of ‘status quo’ is subject to the following conditions:-,,,,,
(i) Attachments shall continue.,,,,,
(ii) The legal and constructive possession of the vehicles in question shall remain with the Enforcement Directorate;,,,,,
(iii) The appellants are prohibited to create any third party right or dispose of the vehicles in question in any manner;,,,,,
(iv) No encumbrance shall be created by the appellants in respect of the said vehicles.,,,,,
With the consent of both the parties, list on 16th April, 2021. The date fixed earlier in the matter i.e. 03rd March, 2021 is cancelled.",,,,,
