Judgment
Tarlok Singh Chauhan, J
The instant petition has been filed for grant of following substantive relief:
"(i) That annexure P7, dated 11.8.2020, whereby toll tax collection work within Yol Cantonment area till March 2021 as been awarded to respondent No.3 and the allotment in favour of petitioner, which has been rejected, may be quashed and set aside.
(ii) That the respondents may kindly be directed to award the work of tax collection work within Yol Cantonment area till March, 2021 to the petitioner, being the highest and successful bidder."
2 Mr. Shashi Shirshoo, learned Central Government Counsel, stated that even though respondent No.3 is the lowest bidder, but he has not come forward to sign the necessary documents and execute the work and as on date the work has not commenced. He further states that it is on account of status quo order, that has been passed on 18.6.2020, the work has not been allotted to the petitioner or for that matter, retendering has not been ordered.
3 Since respondent No.3 has not come forward to even complete documentation muchless execute the work in question, the instant petition is rendered infructuous.
4 In view of above, the petition stands disposed of, as having become infructuous. However, it is made clear that in case the petitioner seeks refund of security amount, the same shall be refunded to him in accordance with rules and procedure and since respondent No.3 has not come forward to execute the work, the petitioner shall not be blacklisted. Pending application(s), if any, also stands disposed of. Parties to bear their own costs.
