Today, there is no representation for Respondent.
From a perusal of record it is seen that Appellants had filed M.A. 139/2020 i.e. an application for waiver of pre-deposit and vide order dated 03.12.2020 the application was dismissed as withdrawn with a liberty to file fresh application.
Later on, Appellants filed fresh application being M.A. No. 152/2020 for waiver of pre-deposit and vide order dated 25.01.2021, this Tribunal by recording reasons dismissed the application.
Now, it is noticed that Appellants have not complied with the provision of the Section 18 (1) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the SARFAESI Act).
In view of above, this Appeal cannot be entertained and has to be dismissed for non-compliance of the Section 18 (1) of the SARFAESI Act.
Hence, Appeal is hereby dismissed.
All Miscellaneous Applications, if any, are dismissed as infructuous.
