Judgment
Heard Mr. J. I. Borbhuiya, the learned counsel for the petitioner. Mr. A. Boruah, the learned counsel is present representing Mr. P. N. Goswami, the
learned Standing Counsel for the PHE Department.
Vide order dated 07.04.2021, the connected WP(C)/81/2020 was disposed of and while doing so inadvertent error crept into the order in making
reference of various work orders and the concerned district wise consignees. This Interlocutory Application is filed seeking for correction of the order
dated 07.0.2021 passed in WP(C)/81/2020.
In view of the submissions of both the learned counsel and having perused the writ petition and the order, I am satisfied that the order needs
correction to the extent as follows:-
In the 2nd line of the 2nd para “Chief Engineer (PHE), Water, Assam vide order dated 19.11.2015 and 10.12.2014,†is required to be modified as
“Chief Engineer, PHE, Assam vide orders dated 19.11.2015, 10.12.2014 and 24.06.2014â€. In the next line instead of “the materials were
required to be supplied to various divisions namely Dibrugarh and Guwahati under the respective Engineer and Consignees were the respective
Assistant Executive Engineer, PHE Dibrugarh Sub-Division, Guwahati Sub-Division†requires modification as follows:-
“The materials were required to be supplied to various divisions in the districts of Dibrugarh, Guwahati, Tinsukia, Nalbari, Belshor, Nagaon and
Jorhat under the respective Executive Engineers and the Consignees were the respective Assistant Executive Engineers, PHE, Dibrugarh Sub-
Division, Guwahati Sub-Division, Tinsukia Sub-Division, Nalbari Sub-Division, Belshor Sub-Division, Nagaon Sub-Division and Jorhat Sub-Divisionâ€.
The rest of the order shall remain same as the one dated 07.04.2021 except an addition after the last line of the 3rd paragraph, “The writ petitioner
shall submit a copy of this writ petition along with the annexures to the concerned department while submitting the copy of this orderâ€.
Accordingly the order passed in this Interlocutory Application shall be read along with the order dated 07.04.2021 passed in WP(C)/81/2020.
With the said observation and the rectification, this Interlocutory Application stands disposed of.
