On 20.10.2021, this court passed the following order:

"Notice. Mr. Sanjay Dalmia, Advocate appears and waives service of notice on behalf of the respondents.

Learned counsel for the petitioner under instructions states that his client is ready and willing to pay entire outstanding amount along with interest till 30th October, 2021, within a period of thirty days.

Let an affidavit to this effect be filed within two days.

List on 22.10.2021."

2 Today, the alleged sole proprietor of the petitioner, Ved Prakesh Bhardwaj has filed an affidavit in the open court, which is taken on record, wherein he has undertaken to pay entire outstanding amount as undertaken by him, to the respondents-Bank before 20.11.2021.

3 In the given facts and circumstances, we deem it proper to dispose of the instant petition by directing the petitioner to pay entire outstanding amount along with upto date interest i.e. accrued till 30.10.2021 to the respondent-Bank by 20.11.2021. Ordered accordingly.

4 As regards the interest between 30.10.2021 uptill 20.11.2021, we deem it appropriate to waive off such interest in view of the undertaking given by the petitioner. Ordered accordingly. However, it goes without saying that in case the petitioner fails to comply with the undertaking given before us, then, he, in addition to the payment of outstanding amount along with interest, even for the period mentioned above, shall be liable to be punished under the Contempt of Courts Act.
