Judgment
Considering that the issues raised in the present petition appear to be answered in the judgment dated 13th July, 2021 of this Court in W.P.(C) No.5449 of 2018 (Maa Bhairabi Industries LLP v. State of Odisha), a direction is issued to the Director of Industries (Opposite Party No.2) to re-examine the prayers of the present Petitioner as made in the representation dated 1st October, 2021 notwithstanding any earlier decision that may have been taken in regard to the sanction and disbursement of the capital investment subsidy under the Odisha Food Processing Policy, 2013 (OFP Policy, 2013).
The fresh decision of the Opposite Party No.2 be taken after hearing the Petitioner by passing a reasoned order on or before 7th February, 2022. The said decision shall be communicated to the Petitioner not later than 14th February, 2022.
If the Petitioner is aggrieved by the decision of Opposite Party No.2, it will open to him to seek appropriate remedies in accordance with law.
The writ petition is disposed of in the above terms.
