In above noted revision petition, arguments were heard on 11.6.2014 by the Bench presided by Justice V.B. Gupta and Mrs. Rekha Gupta, Member. Order dismissing the revision petition was dictated by (V.B. Gupta, J.) with cost of Rs.10,000/- and draft order was sent for concurrence to Mrs. Rekha Gupta, Member on 1.7.2014. Hon''ble Mrs. Rekha Gupta, Member sent her dissenting draft order dated 12.9.2014, for giving due notice to the parties.

As the Bench differed in their opinion, the matter was placed before the President, NCDRC under Section 20(1)(iii) of Consumer Protection Act, 1986 for appropriate directions. The Hon''ble President, referred the matter to Hon''ble Justice V.K. Jain. Hon''ble Justice V.K. Jain, vide order dated 24.12.2014 agreed with the draft order of (V.B. Gupta, J.), that the revision petition has no merit and accordingly the same be dismissed. Consequently, in the light of the majority judgment, the revision petition stand dismissed with cost of Rs.10,000/-. However, the date of compliance shall be read as "13.3.2015" in place of "8.8.2014".

We both members have signed their respective orders today, i.e. on 2.2.2015.
