Judgment
This Appeal which was called in the Court of learned Registrar was directed to be posted before this Tribunal and accordingly the appeal is taken up.
The learned counsel appearing for the appellant has filed a memo seeking permission to withdraw the appeal for the various reasons stated therein which are as follows:
"The appellant has filed the above appeal challenging the Proceeding bearing Order No.RR-II-332/TSPCB/U-I/TF/2017-755 dated 26.05.2017 of the 1st respondent herein by which the 1st respondent has issued directions under Section 33(A) of the Water (Prevention & Control of Pollution) At and Section 31(A) of the Air (Prevention & Control of Pollution) At for closure of the appellant unit.
The respondent has issued an order dated 06.06.2017 granting temporary revocation of the impugned closure order dated 26.5.2017 subject to certain conditions The appellant has been complying with all the conditions and is representing to the respondent Board to issue permanent revocation of closure orders.
Under the circumstances, the appellant is desirous of withdrawing the present appeal.
It is therefore prayed that this Hon'ble Tribunal may be pleased to permit the appellant to withdraw Appeal No.54/2017 and thus render justice."
In view of the said statement made on behalf of the appellant by way of memo filed by the learned counsel for the appellant, the appeal stands dismissed as withdrawn.
