Heard learned Senior Advocate Mr. Kamal Trivedi assisted by learned advocate Mr. Manav Mehta and learned advocate Mr. Jaimin Dave for the
petitioner and learned Additional Solicitor General Mr. Devang Vyas for the respondents through video conference.
At the outset, learned Senior Advocate Mr. Kamal Trivedi, under instructions, stated that the petitioner shall deposit Rs. 10 Lakh without prejudice
to the rights and contentions of the petitioner subject to outcome of the Special Civil Application No. 3374 of 2019 which is pending for adjudication
before this Court wherein the petitioner has challenged the proceedings initiated by the Custom Department and due to pendency of which, respondent
No.2 has declined to renew Letter of Approval to run the unit in Special Economic Zone by the petitioner.
Learned Additional Solicitor General Mr. Vyas appearing for the respondents states that if the petitioner deposits the amount of Rs. 10 Lakh on or
before 31.05.2021, respondent No.2 shall re-consider the decision to renew Letter of Approval and issue renewed Letter of Approval with effect from
01.06.2021 for appropriate period.
In view of above consensus arrived at between the parties, let this matter to be heard with Special Civil Application No. 3374 of 2019. Direct
service is permitted to both sides.
