Judgment

Petitioner proposes to establish a Petrol Retail Outlet at Rausnabad, District Haridwar, for which he has made necessary infrastructure, however,
dealership is yet to be granted to him by an oil marketing company.
Grievance of the petitioner is that the Area Rationing Officer has seized the dispensing unit and other infrastructure belonging to the petitioner.
By means of this writ petition, petitioner has sought following reliefs:
“i) Issue a writ order or direction in the nature of Mandamus commanding the respondent departments to open the M/s Kisan Filling Center,
Rausnabad, Biharigarg Road, Village Anneki, Hettampur, Haridwar, which has been seized/ sealed by the Area Rationing Officer, Bahadrabad,
Sidcul, Haridwar.
ii) Issue a writ order or direction in the nature of Mandamus commanding the respondent no. 2 to take a decision on the application dated 17.11.2020,
moved by the M/s Kisan Filling Center, Rausnabad, Biharigarg Road, Village Anneki, Hettampur, Haridwar through its proprietor (Annexure No. 7 in
this writ petition).â€
After arguing for a while, learned counsel for the petitioner confines his prayer and submits that petitioner has made a representation on 17.11.2020
and Competent Authority be directed to take decision thereupon at the earliest.
Learned Brief Holder has no objection, if such a direction is issued.
Accordingly, the writ petition is disposed of with a direction to District Magistrate, Haridwar to consider and decide petitioner’s representation
dated 17.11.2020 (annexed as Annexure No. 7 to the writ petition), in accordance with law, within a period of six weeks from the date of production
of certified copy of this order alongwith copy of representation.
