The Appellants have filed this application for further extension of time to deposit the balance amount due toward the 1st instalment of the pre-deposit.
The Appellants had earlier filed an application as I.A. No. 801/2023 for an extension of time to deposit the amount toward the 1st instalment and time was granted till 28.12.2023 for depositing a sum of ₹2.50 crores toward the 1st instalment. But the Appellants could deposit only a sum of ₹1 crores toward that, and there is a balance of ₹ 1.50 lakhs due toward the payment of the 1st instalment and there is also a further balance of ₹2.25 crores due toward the 2nd instalment which was due for payment on 20.12.2023. The Ld. Counsel appearing for the Appellants is producing a demand draft for a sum of ₹ 1 crore today and seeks four weeks to deposit the balance of ₹ 50 lakhs due toward the 1st instalment. The Ld. Counsel for the Respondent has vehemently opposed granting further time to deposit the amount.
After hearing both sides, I find that the maximum extension that can be granted for payment of the entire balance of the ₹2.75 crores in only two weeks, and the Appellants are directed to deposit the balance of ₹2.75 crores on or before 15.01.2024.
It is made clear that no further extension of time will be granted and the appeal will stand dismissed in case the payment is not made on the date. The payment being made today shall be received.
