Mr. Nandakumar C. K, the learned Senior counsel for the petitioner, arguing in support of the petitioner's request for interim order, submits the following.

[a] The petitioner has the advantage of a Government Order which permits it to construct a Wind Turbine Generator in Sy.No.386/2 of Kotumuchagi Village, Gadag District and other adjacent lands of the same village.

[b] The fifth respondent is also given an order for similar installation in the same village but not in this survey number.

[c] The fifth respondent is trying to construct a Wind Turbine Generator in the survey number which would obstruct the petitioner's efforts.

[d] In similar circumstances, this Court has granted interim order in W.P.No.25117/2025.

In consideration of these submissions, the interim order is granted directing the petitioner and the fifth respondent to maintain Status Quo as regards the construction of the structure for Wind Turbine Generator in Sy.No.386/2 of Kotumuchagi Village, Gadag District. This order shall be in force until further orders, but with liberty to the respondents to complete the pleadings and seek vacating.

Ms. Saritha Kulkarni, a learned Additional Government Advocate, is called upon to accept notice for the first and fourth respondents. Mr. Piyush Kumar Jain D, a learned Standing counsel for the second and third respondents, subject to entrustment otherwise, is called upon to accept notice for these respondents.

Mr. Abhinay S, the learned counsel for the petitioner, is called upon to ensure copies of the petition/annexures are served on their respective chambers at the earliest.

There shall be emergent notice returnable by 12.03.2026 to the fifth and sixth respondents.

The office is directed to tag this petition along with the petition in W.P.No.25117/2025.

The office is directed to list these petitions with the learned Nominated Registrar if further orders are required for completion of service and the petitions shall be listed with the Court after service of notice, unless an application is filed.
