Heard learned counsel for the parties through video conferencing.
According to the petitioner, he supplied various items during the election to urban local bodies, held in the year 2015. According to him, no payment
has been made. Therefore, he has approached this Court, seeking a mandamus to the respondents to release the amount due to him.
Learned counsel for the petitioner has referred to order dated 22.12.2020 passed in Writ Petition (M/S) No.1262 of 2020 “M/s New Haridwar
Electric Store vs. State of Uttarakhand†and other connected petitions. Learned counsel for the petitioner submits that since the dispute involved in
the present writ petition is identical to the issue raised in Writ Petition (M/S) No.1262 of 2020, therefore, the present writ petition may also be disposed
of in terms of the order dated 22.12.2020 passed therein.
Mr. T.S. Phartiyal, learned Addl. Chief Standing Counsel appearing for respondent nos.1 & 5 and Mr. Sanjay Bhatt, learned counsel appearing for
respondent nos. 2 to 4 submits that since the issue involved in the present writ petition is similar to the issue involved in Writ Petition (M/S) No.1262 of
2020, therefore, the writ petition can be disposed of in terms of order dated 22.12.2020.
In such view of the matter, writ petition is disposed of in terms of order dated 22.12.2020 passed in Writ Petition (M/S) No.1262 of 2020 “M/s
New Haridwar Electric Store vs. State of Uttarakhand†and other connected petitions. Petitioner shall be at liberty to approach the Secretary,
State Election Commission Uttarakhand, Dehradun by making representation. If such representation is made within two weeks from today, decision
thereupon shall be taken as early as possible, but not later than four months from the date of receipt of representation along with certified copy of this
order.
