Judgment
This writ petition was filed by the petitioner praying for the following reliefs:
"10.1 That this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner for perusal of this Hon'ble Court.
10.2 That, this Hon'ble Court may kindly be pleased to quash the order dated 12.03.2021 & 30.03.2021 (annexure P-2) whereby the contract has been terminated.
10.3 That, this Hon'ble Court may further be pleased to issue appropriate directions to the respondents to refund back the amount of Rs. 21,40,723/- which has been debited by transfer by the respondent No. 7.
10.4 That, this Hon'ble Court may kindly be pleased to quash the tender inviting notice/NIT details (Annexure P-3) whereby the respondent authorities have invited tenders for the work which has been allotted to the petitioner and till today it could not be stated due to non-cooperation by the respondent authorities.
10.5 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to extend the time limit to complete the work by the petitioner as the same could not be started due to ignorance, negligence and non-cooperation by the respondent authorities.
10.6 That, this Hon'ble Court may kindly be pleased to pass an order whereby the respondent authorities may kindly be directed to pay the petitioner/society a sum of Rs.5,00,000/- as compensation for mental harassment.
10.7 That, any other writs or directions which this Hon'ble Court deems fit and just in the facts and circumstances of the case be granted to the petitioner.
10.8 That the cost of the petition may kindly awarded in favour of the petitioner."
On 10.10.2022, this Court had passed the following order:
"For the purpose of filing of the writ petition, Vakalatnama was executed in favour of Mr. Shekhar Prakash Shrivastava and Mr. Dharmesh Shrivastava.
Mr. Dharmesh Shrivastava, learned counsel submits by relying upon I.A. No. 04 of 2021 that the petitioner had taken no objection certificate and his file from Mr. Shekhar Prakash Shrivastava on 01.11.2021 and therefore, I.A. No. 04 of 2021 was filed on 26.11.2021 for withdrawal of Vakalatnama.
Since Mr. Dharmesh Shrivastava submits that file has been taken from his colleague Mr. Shekhar Prakash Shrivastava, the Registry will not show the names of Mr. Dharmesh Shrivastava and Mr. Shekhar Prakash Shrivastava as counsel for the petitioner.
In this connection, we have also perused the order dated 25.11.2021, wherein, the submission of Mr. Dharmesh Shrivastava that the brief of the case has been taken away by the petitioner was recorded.
Mr. H.S. Ahluwalia, learned Deputy Advocate General, appearing for the respondents No. 1 to 6, is present.
List this case on 07.11.2022"
It appears that though the brief was taken back by the petitioner from Mr. Dharmesh Shrivastava long back on 25.11.2021, till date the petitioner has not engaged any other Advocate. No authorized representative of the petitioner is also present before the Court.
Mr. H.S. Ahluwalia, learned Deputy Advocate General, appearing for respondents No. 1 to 6 and Mr. Vaibhav Dhar Diwan, learned counsel, appearing for respondent No. 7, are present.
It appears that the petitioner is not interested to prosecute the case, and therefore, the writ petition is dismissed for non-prosecution.
