Judgment
Viney Mittal, J.—A sealed cover has been produced before us by Sh. Anupam Gupta, learned Counsel appearing for the respondent-
University forwarded by the Director, Postgraduate Institute of Medical Education and Research, Chandigarh containing the report of the re-
evaluation of the answer sheets of the petitioner in terms of the order dated August 11, 2006 passed by this Court. The aforesaid sealed cover has
been opened in the presence of the petitioner. The sealed cover contains two evaluation sheets of the answer sheets of the petitioner with regard to
her paper in the subject of Periodontology, BDS, Final Prof. of the examination held in May 2006. The aforesaid evaluation reports indicate that
the petitioner has obtained 27 marks in Part-1 out of a total of 45 marks and 27 marks in Part- II out of a total of 45 marks from one examiner.
The second examiner has chosen to award 27 marks for Part-I whereas 25 marks have been awarded for Part-II . It has been very fairly informed
by Sh. Anupam Gupta that besides the aforesaid marks the petitioner shall also be entitled to the internal assessment marks which were originally
awarded by the University as well as the marks for her practical examinations.
In view of the aforesaid marks, it is apparent that the petitioner has scored marks which are sufficient for passing the Examination. For the
detailed reasons to be recorded separately, the respondent-University is directed to declare the result of the petitioner, keeping in view the
aforesaid re-evaluation, taking the average of the marks by the two evaluators from PGIMER. The result of the petitioner shall be declared by the
respondent-University within a period of one week from today.
Keeping in view the peculiar facts and circumstances of the case, we also request the Vice-Chancellor, Baba Farid University of Health
Sciences to allow the petitioner to join the internship on the strength of the declaration of the result. The petitioner shall also be entitled to pursue
her further career in accordance with law. Original reports submitted by the evaluators of PGIMER have been returned back to Sh. Anupam
Gupta, Advocate.
A copy of the order be given dasti under the signatures of the Bench Secretary.
