Learned counsel for the parties are present.
I.A. No. 8528 of 2022 has been filed for fixing an early date of hearing in this case.
Learned senior counsel for the petitioner has submitted that in spite of repeated opportunities, the respondents have not their filed counter affidavit. She submits that respondents had taken a decision that instead of referring the matter for arbitration, such small grievances of the petitioner can be resolved at their end itself. She submits that such communications has been placed on record and the grievance of the petitioner has not yet been redressed. The matter is pending since 2016 before this court.
The learned counsel for the respondents has no answer for not filing the counter affidavit in the present case. On 15.01.2020 Mr. Gautam Rakesh, Advocate had appeared on behalf of Mr. Mahesh Tewari, learned counsel for the respondents and had prayed for two weeks’ time by way of last indulgence to file a counter affidavit but in spite of that, the counter affidavit has not been filed so far.
At this, learned counsel for the respondent Ms. Prabhat Kumar Sinha has submitted that he shall seek instructions and the matter be posted on 25.01.2023.
Accordingly, I.A. No. 8528 of 2022 is hereby allowed and the matter is directed to be posted on 25.01.2023 to be taken up as a first case at 10.30 A.M.
Office is directed to print the name of Mr. Prabhat Kumar Sinha from the side of the respondents in the cause list.
