In this writ petition, the petitioner has challenged Annexure P-6-notice cancelling a tender “pre-fabricated Class Rooms for Eklavya Model Residential School Bharmour at Holi Chamba, District Chamba” on 11.03.2024 citing administrative reason as the cause without any elaboration, Annexure-R-1, the actual reason furnished alongwith the reply filed by the 2nd respondent and Annexure P-7 cancelling the same tender.
In the supplementary affidavit filed today by the respondents, it is admitted that in Annexure R-1, it is wrongly mentioned that the copies of the documents have not been supplied by all the bidders as per Condition no.19, and it is now clarified that only one bidder Sh. Karan Dutta has not done, so while the petitioner and the other bidders had submitted such documents.
Having regard to the same, the Writ petition is allowed and Annexure P-6, Annexure R-1 and Annexure P-7 are set aside with a direction to the 2nd respondent to pass a fresh order after considering the bids of the petitioner and the other bidder, and communicate the same to the petitioner.
The instant Writ Petition is disposed of with above direction, so, also the pending miscellaneous applications, if any.
