Restoration Application No. 27/ND/2023
This is an application filed under Rule 48(2) read with Rule 11 of NCLT Rules, 2016 for restoration of Company Petition No. IB/289/ND/2020 which was dismissed for want of prosecution on 17.05.2022. Upon hearing the submissions made and having considered the prayers made in the application, the present application i.e. Restoration Application No. 27/ND/2023 stands allowed and main matter i.e. Company Petition No. IB/289/ND/2020 stands restored to its original number. We have heard the submissions made by Learned Counsel for the Operational Creditor. Despite service of notice, no one has appeared on behalf of the Corporate Debtor. Let notice be served on the Corporate Debtor for their appearance as well as for filing rely. Let Court Officer serve e-notice to the Corporate Debtor. Learned Counsel for the Operational Creditor may also serve a private notice along with copy of today’s order to the Corporate Debtor as well as Counsel for the Corporate Debtor on record, if any.
