Heard the learned counsels for the parties.
Learned counsel for the appellants contends that fraud has been committed by the Bank, for which FIR has been lodged in District-Pratapgarh and charge-sheet has also been filed in the said case. Learned counsel for the appellants further contends that he has filed securitization application on behalf of the appellant before the DRT, Lucknow, which is pending consideration. Learned counsel also contends that the Bank has filed an O.A. No. 59/2020 before the DRT, Allahabad, which is also pending consideration. The learned counsel prays that the aforesaid O.A. be transferred to the DRT, Lucknow so that both the matter may be heard together.
Learned counsel for the respondent-Bank contends that the branch of the Bank is at District-Pratapgarh, the property is also at Pratapgarh and the territorial jurisdiction is with the DRT, Allahabad. Learned counsel for the respondent-Bank further contends that he has no objection, if the S.A. No. 187/2019 pending before the DRT, Lucknow is transferred to the DRT, Allahabad.
In view of the above, the present application is disposed off with a direction that the SA No. 187/2019 filed by the appellant before the DRT, Lucknow be transferred to the DRT, Allahabad. The Registrar, DRT, Lucknow is directed to transmit whole record along with I.As., if any, immediately to the DRT, Allahabad and the DRT, Allahabad shall re-register the said S.A. and decide the same expeditiously.
A copy of this order be sent to the parties as well as to the DRTs concerned.
