The Petitioner questions the show cause notice dated 3rd January, 2015 issued by the Secretary, Department of Steel and Mines, Government of Odisha requiring the Petitioner to show cause why grant of mining lease in its favour by the letter dated 20th August, 2007 shall not be revoked.

A reply was filed by the Petitioner to the show cause notice way back on 17th January, 2015. It appears that thereafter the Petitioner was not informed of the decision on the said show cause notice. The Petitioner thereafter filed the present petition. On 11th February, 2015 an interim order was passed to the effect that further proceeding pursuant to the aforementioned show cause notice shall remain in abeyance.

Having heard Mr. Rath, learned counsel for the Petitioner and Mr. P.M. Muduli, learned Additional Government Advocate for the State (Opposite Parties), the Court is of the view that the order on the show cause notice should be asked to be passed in a time bound manner after hearing to the Petitioner. Accordingly, it is directed as under:

(i) On a date to be indicated to the Petitioner at least ten days in advance, the Principal Secretary, Department of Steel and Mines, Government of Odisha will give an opportunity of hearing to the representative of the Petitioner; and

(ii) a reasoned and speaking order will be passed on the said show cause notice by the Principal Secretary, Department of Steel and Mines on or before 7th March, 2022 and the said order shall be communicated to the Petitioner not later than 14th March, 2022.

If aggrieved by the said order, it will be open to the Petitioner to seek appropriate remedies in accordance with law. It will also be open to the Petitioner to urge all the contentions raised in the present petition before the authority concerned.

The writ petition is disposed of in the above terms.

An urgent certified copy of this order be issued as per rules.
