This matter is taken up through hybrid arrangement.
This I.A. has been filed by the Appellants for stay operation of the impugned order dated 23.11.2021 under Annexure-4 passed by the learned Civil Judge, Senior Division (Commercial Court), Cuttack in C.S. No.264 of 2020.
Heard.
Learned Senior Counsel appearing for the Appellants submits that though this Court vide order dated 01.11.2022 granted stay operation of the aforesaid impugned order, but somehow the stay order has been escaped from the attention of the Stenographer which could not have been recorded.
In such view of the matter, prayer for interim relief made in the I.A. is allowed. Accordingly, it is directed that the impugned order dated 23.11.2021 under Annexure-4 passed by the learned Civil Judge, Senior Division (Commercial Court), Cuttack in C.S. No.264 of 2020 shall remain stayed till the next date.
List the ARBA on 5th January, 2023.
Urgent certified copy of this order be granted on proper application.
