Judgment
R.S. Sodhi, J.—By order, dated 1.9.2001, the learned Metropolitan Magistrate was pleased to release the case property, namely the currency after taking photostat copies thereof, to which the accused persons have made statements that they would not challenge the identity thereof. Further, the court has also imposed a condition that a bank guarantee be furnished for a sum of Rs.35,00,000/- (rupees thirty five lakhs only) equivalent to the amount of currency sought to be returned. A further condition was imposed that the original currency notes would be produced in court as and when required. This condition to my mind is unnecessary in view of the fact that photostat copies of the currency notes have already been taken on record. If the procedure described in paragraph 6 of the order is complete and the currency notes released to the petitioner, he shall be at liberty to utilise the same and the original need not be produced. The bank guarantee shall continue to be kept alive unless ordered otherwise.
The order be given DASTI to counsel for the petitioner.
