Provisions of Section 29A(4) of the Arbitration and Conciliation Act have been invoked second time by the petitioner for extending the period of making the Arbitral award.
Vide order dated 10.01.2023, passed in Arbitration Case No. 89/2022, time to complete Arbitral proceedings in the matter was extended up to 31.03.2023. The order pertains to arbitration in the matter of M/s C&C Constructions Ltd. Vs HPRIDC in respect of the disputes arising out of a contract for executing the Balance work of widening and strengthening of Theog-Kothkai- Kharapathar Road Section from Km 0+000 to Km 48+000 (48 Km) in October, 2013.
Learned Senior Counsel for the petitioner has placed on record proceedings of 38th Meeting (Internal Virtual Meeting) of learned Arbitral Tribunal held on 2nd March 2023 and on that basis submitted that the learned Arbitral Tribunal has tentatively fixed 25.06.2023 as the date for announcement of the Arbitral award. Learned Senior Counsel for the respondent has no objection for extending the period of making the Arbitral award.
In view of submissions made by learned Senior Counsel for the parties, time to complete the Arbitral proceedings is extended till 30.06.2023. The petition to stand disposed of alongwith pending miscellaneous application(s), if any.
