Challenge in the instant petition is to the notices at Annexures P-1 to P-8 issued by the office of Market Committee, Barnala calling upon the petitioner firm to deposit market fee as also rural development fund in addition to penalty.
It is inter alia contended that under Section 23 of the Punjab Agricultural Produce Markets Act, 1961 as also Rule 29 of the Punjab Agricultural Produce Markets (General) Rules, 1962 no fee is leviable in respect of any transaction in which delivery of the agricultural produce bought or sold is made outside the State.
Counsel submits that against the impugned notices the petitioner firm has already approached the Market Committee, Barnala but no final decision in regard thereto has been taken till date.
Counsel submits that he would be satisfied if at this stage the writ petition was to be disposed of with a direction to respondent no.3 to look into the matter in the light of the representations already made.
Prayer made by counsel is found to be just and reasonable. Without ascertaining the correctness of the averments made in the petition and without opining on the merits of the contentions raised by counsel, I deem it appropriate to dispose of the writ petition with a direction to respondent no.3 to examine the matter against the backdrop of a representation dated 24.5.2019 (Annexure P-10). A final decision be taken expeditiously and in any case within a period of two months from today and be conveyed to the petitioner.
Petition is disposed of.
