It is submitted that the matter has been settled between the parties in National Lok Adalat held on 11.05.2023. The parties have come to a settlement and consent terms are filed along with this application which is for withdrawal of the appeal as well as withdrawal of the pre-deposit lying before this Tribunal.
The Ld. Counsel appearing for the Respondent submits that as per the terms of the settlement, certain more amounts need to be paid to the bank and therefore from out of the deposit amount, ₹40,00,000/-may be directed to be paid to the Respondent.
The Ld. Counsel appearing for the Appellant under instructions agrees to that suggestion and hence, the appeal is disposed of as withdrawn. After recording the consent terms of settlement and the amount in deposit together with the accrued interest except a sum of ₹ 40,00,000/- shall be returned to the Appellant on proper acknowledgement.
The amount of ₹ 40,00,000/- shall be disbursed to the Respondent Bank towards appropriation to the loan.
