The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No.2-Divisional Engineer (Electrical), Greater Mohali Area Development Authority (‘GMADA’), S.A.S. Nagar (Mohali) to consider and decide its representations dated 26.11.2025 and 30.01.2026.

On 29.01.2026, this Court passed the following order:

“Limited prayer made in the writ petition is for directing respondents to decide representations, Annexures P41 and 42. Counsel for the petitioner states that petitioner is executing the works by virtue of an agreement executed between the petitioner and Greater Mohali Area Development Authority (GMADA). She states that the terms and conditions of the agreement have been laid down in the bidding document, Annexure P1.

On a specific query as to whether there is any provision for submission of a representation or its decision, counsel has made a reference to Clause 25 of the agreement, Annexure P1, which provides for dispute resolution mechanism. She has made a reference to Clause 25 (ii) to assert that by virtue of representations, Annexures P 41 and 42, petitioner has raised a dispute. However, perusal of the two aforesaid annexures show that no dispute has been raised by the petitioner rather the annexures are more in the shape of questions raised to the respondents and request has been made for passing a speaking order.

At this stage, counsel for the petitioner requests for a short accommodation to get instructions and assist the Court.

As per petitioner, during the pendency of captioned petition, the petitioner has preferred grievance on the portal of Connect Punjab, Government of Punjab with a prayer to pass a speaking order in context to various issues related to defective 37 Nos.CSS. The same has been forwarded to Sub-Divisional Engineer, GMADA. As per Public Grievance Redressal Policy, 2020, it is mandatory for the respondent to decide petitioner’s representation.

Learned counsel for respondents assures the Court that competent authority would consider petitioner’s representations and pass an appropriate order in accordance with law within 6 weeks from today.

Learned counsel for the petitioner agrees to aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of.
